The government shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed by any local, county, or state government.
The federal government divided into 3 major branches being the executive, judicial, and legislative branch. The executive branch led by the president enforces the law. The judicial branch led by the chief justice interprets the law. And the legislative branch led by the speaker of congress makes the law. These branches combined shall rule over the territories of the United States of Wesarvy & serve to protect its citizens.
The Congress, whenever two-thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution. State governors & legislators shall need to give a majority acceptance of the change before the proposal shall be sent to the supreme court which will judge the ethics of the change. If the constitutional change is judged acceptable by the supreme court of the United States of Wesarvy then the proposal shall be given to the president who holds a final say in the acceptance or rejection of the constitutional change.
Presumption of innocence, all citizens will be considered innocent until proven guilty before the courts. No person shall be held to answer for a capital, or otherwise, infamous crime, unless on a presentment or indictment of a federal court. Nor shall any person be forced in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
The right of all adult citizens of the United States to vote shall not be denied or abridged by the United States or by any State.
The President shall be given the supreme authority to federalize state or local agencies, declare war, marshall law, and disband state governments. During marshall law, non-federal governments, courts, and legislators shall temporarily lose their authority. All law enforcement shall be placed under the authority of the Department of Homeland Security. Marshall laws can be used to regain control of the nation in times of great uncertainty and unrest.
All people born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and or the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the borders of the United States of Wesarvy, or any place subject to its direct jurisdiction.
The act of high treason is defined as a major act of aggression or terrorism against the President, Vice President, Congress Speaker of the House, or Chief Justice of the Supreme Court of the United States of Wesarvy with the intent to kill, hurt or destabilize these entities. It is also considered high treason to lie to, withhold information from, or knowingly provide misleading information to the President of the United States of Wesarvy. Those who are found guilty of high treason by the supreme court shall be banished from the United States of Wesarvy unless pardoned by the President.
Aurora D.C. shall serve as the capital seat of power to the federal government housing the executive, judicial, and legislative branch. The city shall act as both a state and city with the power to elect 1 senator to the senate and 1 representative to the house. The mayor of Aurora D.C. shall be appointed by the president with the advice of the senate for a period of 4 months with a 3-term limit. The city itself shall not excide more than x. Nor shall any state nor any of its agencies hold any authority over the capital city or power over its agencies.
Congress shall be comprised of the house of representatives and the senate. Members of the house are chosen in a federal election by the people of the nation. Every state shall elect 2 representatives to the house. The house of representatives shall have the power to draft laws, conduct investigations into government officials of other branches by means of public hearings, start impeachment trials, and manage the congress quarterly budget. Members of the senate are chosen by the members of their state legislative branch and governor. Every state shall elect 1 senator to the senate. The Senate shall have the power to approve or dismiss laws created by the house, act as judge over impeachment trials, accept or deny the spending of the congress budget by the house, and guide the president on the appointment of government officials. Congress shall elect a member of the house of representatives by popular vote to the position of the speaker who shall lead congress during official meetings, manage the congress staff & represent the legislative branch. During official voting sessions of the senate, the Vice President shall be given an extra vote in order to break a tie they shall also act as chairman over senate meetings. The senate holds the right to hold a public or private meeting with the President's candidates for the offices of the vice president, attorney general, or any of the cabinet secretaries before they take office. The senate shall be informed before the president can appoint members to his executive offices. Members of the supreme court can appoint district and appeal court judges to their respective offices. The right to elect supreme court justices shall be given to the senate with the approval of the president. The chief justice appointed by the president shall be given a veto to block the appointment of new supreme justices and can also nominate judges for the supreme court to the senate.
The power to impeach judges, governors, district attorneys, or the Vice President is reserved for congress. Only they shall officially impeach one of the above-stated officials if they misrepresented the good people of the nation or the government itself or committed high treason. An individual who is impeached shall no longer be allowed to act in a public government role for a duration of 3 months. Removal from office based on criminal offenses is reserved for only the courts. However, individuals who are removed from office on whatever grounds are still allowed to receive a governmental salary, and in the case of removal by courts to hold a governmental title. For only the President holds the right to revoke these privileges. An impeachment trial has to start in the house where any of its members can request to hold a majority vote in order to start the trial. Members of congress who approved of the impeachment shall start to gather evidence by holding public hearings where they can order anyone to appear before them. Those who do not appear shall receive large fines as punishment. When the house feels that it has gathered enough information it shall appoint a special counsel. After the house has appointed its special counsel the senate shall organize a public trial where the accused shall have the right to defend themselves while the special counsel shall in name of the house make its case against the accused. The impeachment shall be completed when the senate passes its final judgment after 3 public hearings with the accused and the special counsel.
Governors within the borders of their state and its authority shall serve as its territories commander-in-chief with the supreme authority over its states agencies. The governor will also be given the power to veto all local and state-level decisions within the state's border and represent the state to the federal government. The Lieutenant-Governor shall act as chairman over the state's legislative branch and take office in order to act as acting governor if the governor themselves is temporarily or permanently unable to do his duties. All states are to have a state constitution written by its legislative branch and approved by its governor. These state constitutions like their federal counterpart shall provide supreme power and regulations over the government entities within its borders. However, federal law and the federal constitution shall always dominate over state law and the state constitution.
United States of Wesarvy presidential line of succession. Whenever the President is temporarily or permanently not able to perform his duties the following are to take office in his name. Vice President, Attorney General, Secretary of the Treasury, Secretary of Civil Services, Secretary of Homeland Security, Director of National Intelligence, and the Speaker of the Congress. If no designated survivors are available or fit for office after being judged by the senate then the Chief Justice of the Supreme Court shall take office as the acting President of the United States of Wesarvy until new elections can be held. A fair and well-organized government shall be kept by gifting the good people of the nation a public voice. Every 6 months election shall be held for the offices of the state governors & lieutenant governors. Public elections for the seats of congress in the house of representatives and the senate shall be held every 3 months. The president and vice president shall be elected into office every year by means of the public vote. The chief justice shall administer the oath of office for the president, vice president, speaker of congress & governors. If the chief justice is not available or unwilling to do his duty then the most senior member of the supreme court willing shall be asked to administer the oath of office.
The sitting president and his or her vice president shall be gifted with complete immunity from both criminal & civil law. They shall not be brought before the courts for any crime or felony committed while in office. Nor shall anyone be allowed to charge a former president & vice president with a crime or felony committed during their time in office unless they were successfully impeached by congress while they were still in office. The sitting president shall also have the power to grant reprieves and pardon United States citizens and officials for any crime they committed, except in the cases of impeachment
No citizen of the United States of Wesarvy shall be held captive nor punished by courts or nations outside of the jurisdiction of the United States Federal Government. Nor shall the Federal Government of the United States of Wesarvy permit the transfer of a US citizen towards another nation for criminal or civil punishment. The Federal Government of the United States of Wesarvy shall protect and safely return any US citizen back to the United States of Wesarvy who is captured, punished, or trait in a court outside of the US.
